Once you’ve selected the profiles that you’re interested in learning more about, we will share their public profile with you. If there are any FDA or medical considerations, a potential Surrogate needs to be made aware of, one of our physicians is available to discuss this with them before moving forward. The final step is to schedule a meet and greet video chat with your potential Surrogate Mother, allowing you to move forward with confidence.
After confirmation of a match by both you and your Surrogate, our agency agreement is signed, and you officially become an Intended Parent with Physician’s Surrogacy. We do not ask you to sign a contract until a two-way match is confirmed. Your Surrogate then goes through a comprehensive medical screening at your IVF center.
A psychological screening is conducted, ensuring that your Surrogate is medically and emotionally prepared to prioritize a surrogacy journey.
Once your Surrogate completes the screening, a medical clearance letter is issued, allowing you to proceed to the legal contract phase. Both you and your Surrogate Mother have your own legal representation. Antenatal testing is used to evaluate your baby’s well-being throughout your surrogate’s pregnancy. For many of our Intended Parents, antenatal testing provides reassurance that their baby will be healthy and reduces the chances of unforeseen challenges. While in many OB offices this testing is reserved only for high-risk pregnancies, most Intended Parents who undergo IVF and surrogacy view it as peace of mind that their child will be healthy. Unfortunately, most Intended Parents are not even aware these tests are available, nor do they have the opportunity to elect to have them done. As physicians, we understand the importance of timeliness and the delicate details of medical protocols. We work closely with your IVF center from the beginning of the IVF process until graduation, ensuring a smooth start to the pregnancy.
Working closely with you and your Surrogate, we support you by ordering NIPT testing (Non-Invasive Prenatal Testing) and providing the results to the managing OB, a service no other agency offers. An unregulated surrogacy program is just a private agreement between the Intended Parents and the Surrogate. The contract has no legal weight and can’t be enforced. There is no legal protection for the parents if the Surrogate should choose to change her mind and request custody of the baby. Any dispute of the child’s custody will be resolved in local Family Court, where laws invariably support the rights of the birth mother. The lack of any legal framework opens the possibility of “regulation at whim” of the local authorities. This has happened several times in other countries where, in the absence of a legal framework, a conservative administration proclaimed overnight (literally) that surrogacy would be treated as a form of Human Trafficking. Yes. Once you get a match with a Surrogate, we will draft an agreement. We will negotiate it on your behalf with your Surrogate’s independent attorney. These contracts cover everything from the medical procedure to your Surrogate Mother’s reimbursement costs during the whole surrogacy process. It will also clearly mention the amount of contact you would like to have with the Surrogate during the process. There are two separate attorneys in the process. One will represent you, the Intended Parents while the other represents the Surrogate. This avoids any conflict of interest.
The amount of contact between the Intended Parents and the Surrogate varies case by case. Both parties shall determine & agree upon the contract during the matching process. Some cultures are a little more closed off than others; however, the relationship and communication develop as the journey progresses.
It depends on the agency you choose to work with. Most agencies have a 6-18 month waiting list to match with a surrogate. Some also require you to sign a contract and pay agency fees for them to begin the process of matching. If you do not live in the United States, you will need to travel to the U.S. at least once. This trip is for the delivery of your child. Another time would be to create your embryos at an U.S. clinic. If you prefer creating the embryos without having to travel, you can choose to either have your embryo transported or send your eggs/sperm to the U.S. clinic. Should you choose to come to the U.S. for the embryo creation the trip will include an introductory meeting with the Surrogate. On the same visit, we conduct your medical screening and then the creation of the embryos at the IVF clinic.

*Consultation: The entire process begins with a complimentary surrogacy consultation with our experienced team which requires no cost. *Matching: Our average matching timeline is one week. This successful and dynamic matching timeline is attributed to our comprehensive 3-4-month medical pre-screening. Our in-house OB’s supervise the pre-screening process of our Surrogates. Before we present a potential Surrogate candidate, she has undergone a thorough background check. Moreover, our physician team has already screened all of her pregnancy histories. Lastly, she has undergone proper and necessary lab work, qualifying her to become an eligible candidate through our agency.
*Screening: Once we have a confirmed two-way match (Intended Parents & Surrogate), the Surrogate will go through the final stages of medical and psychological screening. The whole process takes place through the IVF clinic which the Intended Parents have chosen. Once the Surrogate has been cleared, we move into the legal phase.
*Legal: The legal contract phase is typically two to four weeks. Your attorney drafts the agreement and works with your Surrogate’s attorney to establish the terms of all aspects of the journey, including parental rights and obligations of both parties. Later there will be a second legal stage to establish parentage. You will have unlimited access to your attorney and your Surrogate’s attorney during the contractual phase and the entire journey.
